This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in the course of our business, including when you use our website or engage our consulting and automation services. It also describes your rights and choices regarding your personal information. Cuespan is based in Washington State, USA, and we comply with applicable U.S. privacy laws (such as the California Consumer Privacy Act for California residents). Note: We do not currently target or offer services to EU residents and are not subject to GDPR requirements.

By using Cuespan’s website or services, you consent to the data practices described in this Policy. If you do not agree with this Policy, please do not use our services or website.

1. Information We Collect

We may collect various types of information, including personal information and non-personal data, either directly from you or through your use of our services and website:

However, we might receive your information from third parties in some cases – for example, if one of our business partners refers you to us, or if we are engaged as a subcontractor and the prime contractor provides us your contact details. We will handle that information according to this Policy. We do not purchase consumer lists or data from brokers.

We do not knowingly collect sensitive personal information (such as social security numbers, driver’s license numbers, financial account information, or precise geolocation) unless it is necessary for a specific consulting engagement and provided by the client. We also do not seek to collect data from individuals under 13 years of age (see Children’s Privacy below).

2. How We Use Your Information

Cuespan uses the collected information for purposes consistent with our role as a professional service provider. The uses include:

Providing and Improving Services: We use personal and project information to plan, perform, and deliver our consulting and automation services to you. With Service Providers/Subcontractors: We may share your information with trusted third-party service providers or subcontractors who perform functions on our behalf to support our business or assist in delivering our services. Within Our Corporate Group: If Cuespan is part of a group of affiliated companies (e.g., subsidiaries or common ownership), we may share information within that corporate family as needed to provide services and for internal administration. All recipients will similarly be bound to protect the information.
Business Transfers: If we consider or undergo a business transaction such as a merger, acquisition by another company, reorganization, or sale of all or a portion of our assets, personal information may be disclosed to prospective or actual purchasers (and their advisors) as part of the due diligence or as a transferred asset. In all such cases, we only share the minimum information necessary for the purpose and, where applicable, will anonymize or pseudonymize data to protect privacy.

8. California Privacy Rights (CCPA)

If you are a resident of California, you have specific rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights include: the right to know what personal information we collect about you and how we use and share it, the right to delete personal information collected from you (with certain exceptions), the right to opt out of the sale or sharing of your personal information, and the right to non-discrimination for exercising your privacy rightsoag.ca.gov. Categories of Personal Information Collected: In the past 12 months, we may have collected (from California consumers acting as representatives of our business clients or as visitors to our website) identifiers like name, contact information, internet or other electronic activity information (from website visits), and professional or employment-related information if provided by the consumer (e.g., job title, company). We collect these categories from the sources and for the purposes described in this Policy (see Sections 1 and 2 above). We will acknowledge your request and respond within the time frames required by law (generally within 45 days, with the possibility of an extension). We will verify your identity to a reasonable degree of certainty before providing substantive response, which may involve matching provided information with our records.

For requests to opt-out of sale/sharing: While we do not sell data, if you still wish to formally record an opt-out request, you may contact us and we will note your preference. We also recognize the Global Privacy Control (GPC) signal for opt-out of sale/sharing – if our website detects such a signal from your browser set to a California location, we will treat it as a valid opt-out request.
Cuespan will not discriminate against you for exercising any CCPA rights. If a request is denied (such as a deletion request that falls under an exemption), we will explain the basis for the denial.

9. How We Protect Information (Security Measures)

(See Data Security section above for details.) We reiterate that Cuespan uses administrative, physical, and technical safeguards to protect personal information. This includes employee training on privacy, access controls, encryption and secure protocols for data in transit where appropriate, and vetting our third-party providers’ security practices. Despite these efforts, no security measures are infallible. If we become aware of a security breach involving personal data, we will take prompt action to mitigate it and will notify affected parties and authorities as required by Washington’s data breach notification law or other applicable laws.

10. International Data Transfers

Cuespan primarily stores and processes data in the United States. If you are located outside the U.S., please be aware that any information you provide will be transferred to and stored in the U.S. Our clients are mostly U.S.-based (e.g., Washington, California), and our services are not directed to other countries. In the event we need to transfer personal information internationally (for example, if a subcontractor outside the U.S. is assisting on a project), we will do so in compliance with applicable data protection laws. We will ensure there are appropriate safeguards in place, such as standard contractual clauses or equivalent mechanisms, to protect the data being transferred. By providing us information or using our services, you acknowledge any such transfer, processing, and storage of your information in the U.S. or other jurisdictions as necessary.

11. Children’s Privacy

Our services and website are not intended for children under the age of 13, nor do we knowingly collect personal information from children under 13. If you are under 13, do not use our website or send any personal information to us. If we learn we have collected or received personal data from a child under 13 without verification of parental consent, we will promptly delete that information. If you believe we might have any information from or about a child under 13, please contact us so that we can take appropriate action. (For minors aged 13-16 in California, we do not sell their information either, in compliance with CCPA’s minors provision.)

12. Links to Other Sites

Our website or deliverables may occasionally contain links to external websites or services that are not operated by Cuespan. For example, our website might link to a partner’s site, an article of interest, or software documentation. This Privacy Policy does not apply to those third-party sites. We are not responsible for the content, security, or privacy practices of any external sites. We encourage you to review the privacy policy of any site you visit via links from our site. Clicking on those links is at your discretion, and providing personal information on third-party sites is subject to their policies.

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other reasons.
